The Brown Deer Village Board will hold a hearing Monday, July 16, to determine if it will revoke the conditional-use permit for a garage on North Teutonia Avenue.
According to a memorandum from Building Inspector Robert Premo, Richard Meishner, owner of RPM Sales and Service, 7725 N. Teutonia Ave., has failed to meet the terms of the conditional-use permit and development agreement.
The property violates the conditions in a number of ways. There is a second business, Brown Deer Service, on the site. No occupancy authorization or conditional-use permit was granted to Brown Deer Service.
In addition, two more buildings have been built on the site, although they are not permitted. There is exterior storage of junk vehicles, and trucks and service vehicles are not being parked in areas designated by the development agreement. A letter to Meishner, dated Jan. 30, 2006, outlined those violations as well as others.
The property was re-inspected March 19, 2007. Premo wrote that he found many of the violations had not been corrected although some scrap metal was removed.
Village Attorney John Fuchs said village staff does not have the authority to take away a use.
"The board can do that," he said. "If the board does that, then the business can be deemed a nuisance."
Once declared a nuisance the village could seek relief in Milwaukee County Circuit Court.
"This particular property has been enough of a problem for you to set a hearing," Fuchs said.
Fuchs suggested setting the hearing in July to allow additional time for Meishner to talk with the village about making corrections on the property.
Meishner did not return a reporter's phone call.
